Notice under Article 14(2) of the Electricity (Northern Ireland) Order 1992
Modification of the Participation in Transmission Licence held by Northern Ireland Electricity Ltd (formerly Northern Ireland Electricity plc)
In pursuance of its powers under Article 14(1) of the Electricity (Northern Ireland) Order 1992 (as amended) (hereafter referred to as the “Order”), the Northern Ireland Authority for Utility Regulation (hereafter referred to as the “Authority”) hereby gives notice under Article 14(2) as follows:
1. It proposes to modify the Participation in Transmission licence (the “Licence”) held by Northern Ireland Electricity Limited (granted in the name of Northern Ireland Electricity plc) (the “Licensee”).
2. The reason for the proposed modifications put forward in this Modification Notice is to implement new price control arrangements applicable to the period 01 January 2013 – 30 September 2017 (the “RP5” price control). The detail of the RP5 price control is available in our RP5 final determination document published on our website.
3. The effect of the proposals is to delete the current Annex 2 and insert a new Annex 2 to the Licence. Annex 2 details the price control arrangements that are applicable. Consequential modifications are proposed to the conditions of the licence. These will have the effect of amending the relevant licence conditions to reflect the new price control in the new Annex 2. These include:
i. updating definitions to reflect changes in the legislation they relate to. These are: “Directive” and “Directive Regulations” as given in Condition 1.
ii. the insertion of a new licence condition – Condition 46. This condition sets out the requirements in respect of the new ‘Reporter’ function being introduced in the RP5 price control period.
4. A copy of the proposed modifications is set out in two documents published along with this notice. These documents are a tracked change copy of the Licence, and a copy of the new Annex 2 of the Licence. 5. Representations or objections with respect to the proposed modifications may be made on or before 17:00 on 20 November 2012 to:
6. The Authority has, pursuant to Articles 14(3) and 14(4) of the Order respectively, served a copy of this notice on the Licensee and sent a copy to the Department of Enterprise Trade and Investment.
