The Utility Regulator has published a decision on licence modifications required to implement the new Code of Practice (CoP) for Consumers in Vulnerable Circumstances.
These licence modifications follow on from the publication of our Best Practice Framework decision paper on the introduction of the new CoP and publication of a notice and consultation on the licence modifications.
The responses to the consultation notice are published alongside the decision.
The objective of this new CoP is to address the current gaps in the service provision for utility consumers in vulnerable circumstances within Northern Ireland, and ensure they are identified, adequately protected and receive an appropriate level of support from the three regulated sectors.
The new CoP will also ensure that the support and protections offered to Northern Ireland consumers are consistent, adequately promoted and reflective of best practice exemplars seen in Great Britain and across other jurisdictions and regulated sectors.
The licence modifications apply to utility suppliers and distribution network operators in the three regulated sectors in Northern Ireland.
An additional modification (in addition to the best practice framework changes) is also made to NI Water’s licence to align the licence with current regulatory processes and requirements
The relevant Decision Notices are being published to introduce the modifications and new licence conditions to implement the new Code of Practice for Consumers in Vulnerable Circumstances:
- Decision Notice under Article 14(8) of the Electricity (Northern Ireland) Order 1992;
- Decision Notice under Article 14(8) of the Gas (Northern Ireland) Order 1996; and
Decision Notice under Article 20(8) of the Water and Sewerage Services (Northern Ireland) Order 2006.
This licence condition and modifications apply to NIE Network’s distribution license, all gas conveyance (distribution) licences, NI Water’s licence and all electricity and gas supply licences.
The licence modifications will come into effect on 25 November 2024.
