On 17 December 2018, the Utility Regulator (UR) received the all TSOs’ proposals on:
- Methodologies for pricing balancing energy and cross-zonal capacity used for the exchange of balancing energy or operating the imbalance netting process pursuant to Article 30 (1) and Article 30(3) of Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing;
- Implementation framework for a European platform for the exchange of balancing energy from frequency restoration reserves with manual activation in accordance with Article 20 of Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing; and
- Implementation framework for a European platform for the exchange of balancing energy from frequency restoration reserves with automatic activation in accordance with Article 21 of Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing.
Article 5(6) of Commission Regulation (EU) 2017/2195 requires all Regulatory Authorities to consult and closely cooperate and coordinate with each other in order to reach an agreement and issue a decision within six months following receipt of submissions to the last Regulatory Authority by 11 August 2019.
On 23 July 2019, all Regulatory Authorities agreed to request ACER to adopt decisions on the above proposals (attached as annexes to this Information Note) pursuant to Article 5(7) of the EBGL because Regulatory Authorities could not reach an agreement. ACER shall adopt its decisions by no later than six months after the day of referral, in accordance with Article 8(1) of Regulation (EC) No 713/2009.
