On the 13th June 2011 the UR consulted on proposed modifications to Northern Ireland Water’s Instrument of Appointment (the “Licence”) in relation to amendments to:
(i) Condition B: Charges
(ii) Condition F: Accounts and accounting information
These proposed modifications were undertaken in order to reflect the treatment of Northern Ireland Water as a Non Departmental Public Body that is subject to the normal public expenditure processes. The effects of the proposed modifications were to:
(i) Remove from Condition B all the material relating to the first three Charging Years commencing on 1st April 2007, which are now past;
(ii) Align the Licence with the Memorandum of Understanding and the Consequent Written Agreement between the Department for Regional Development and the Authority.
The consultation period ended on 11th July 2011 and the Utility Regulator received a total of four responses to the consultation.
The Utility Regulator has carefully considered all of the responses received and replied to each consultation respondent.
Northern Ireland Water has formally accepted the proposed licence modifications.
